can builders charge occupancy fee without having occupancy permit for shell building from city?
It relates to new commercial plaza where builder is charging occupancy fee but building has not got occupancy permit from city - The builder has not yeT complied with city safety code act . The city is allowing construction to different units holders in the plaza but denying occupancy ( cannot practice profession as building has outstanding safety issues), in terms there is no occupancy to base building granted by city but builders are charging occupancy fee
Usually when the permit comes up to be issued they have to charge an impact fees. So yes you usually have to pay a certain amount before they issue the permit.
The city may charge a minimal impact fee but it is usually for the entire commercial building even though it is just a shell.
When they come in to then do individual permits for the units depending on the type of business then you may have additional fees to pay.
Like fast food restaurant would sometimes have more impact fees rather than a casual dining restaurant because the fast food restaurant would have more traffic than the casual dining restaurant.
If you are only renting/leasing part of the building then I would question if the impact fees are for the entire building OR the unit. Usually the building owner pays for the impact fees.
