once in a while i watch a 5 yr old boy when his mom has to go to meetings
every time i watch him, i notice things go missing. a few days later his mom returns the stuff

I would take him to your local police station the next time he is in your care. Whether he takes anything or not, the first stop should be the police station. Let them have a talk with him. They may show him the jail cells (if no one is in them at that time, may even put him in one for a few minutes) and hopefully he will listen to them.
Obviously the mother isn't going to take care of it, so I would at least try this step.
Maybe you should give the mother the directions to the police station, sounds like she will be picking her son up there at some point in his future!
